These Terms of Use ("Terms") govern your access to and use of the website upheave.tech and any of its subdomains and pages (the "Website"), operated by Upheave technologies d.o.o. ("Upheave", "we", "us", "our"). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

2. Scope and acceptance

These Terms apply to your use of the Website as an information resource. They do not by themselves create any client, service, or contractual relationship for Upheave's services. Any engagement for our services (product development, AI operations, web platforms, design, and related work) is governed exclusively by a separate written agreement signed between Upheave and the client (e.g. a Master Services Agreement, Statement of Work, or individual contract). In the event of any conflict between these Terms and such a signed agreement, the signed agreement prevails for the subject matter it covers.

Your continued use of the Website following any changes to these Terms constitutes acceptance of those changes.

3. Nature of Website content

The content on the Website is provided for general information about Upheave and its services. It is not an offer, quotation, warranty, or binding commitment, and it does not constitute professional, legal, financial, or technical advice. Descriptions of services, case studies, and project outcomes are illustrative and do not guarantee comparable results.

Upheave technologies d.o.o. is committed to keeping the Website accurate and up to date. If you find information that is incorrect or outdated, we would appreciate a message to office@upheave.tech indicating where on the Website you found it, and we will review it as soon as reasonably possible.

4. Intellectual property

All intellectual property rights in the Website and its content — including text, graphics, layout, design, logos, illustrations, code, and other materials — are owned by or licensed to Upheave technologies d.o.o. and are protected under the Croatian Copyright and Related Rights Act (Zakon o autorskom pravu i srodnim pravima) and applicable EU and international law.

You may view and access the content for your own personal and non-commercial use. Copying, reproduction, distribution, modification, publication, or any other use of this content is not permitted without our prior written permission, except where and only to the extent permitted by mandatory law (such as the right to quote).

Third-party names, brands, client logos, and trademarks displayed on the Website are the property of their respective owners and are used with permission or for identification purposes only. Their appearance does not imply any endorsement.

5. Acceptable use

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory Croatian law — including liability for intent (namjera) or gross negligence (krajnja nepažnja), or for personal injury or death caused by our negligence. Where liability cannot be excluded but can be limited, it is limited to the minimum permitted by law.

We process personal data in accordance with the General Data Protection Regulation (EU 2016/679) and applicable Croatian law. Any dispute arising out of or relating to these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the competent court in Zagreb, Croatia, unless mandatory law provides otherwise.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced by a valid one that most closely reflects its original intent.
